In 1993, Act 848 was enacted by the legislature of the State of Louisiana.  Act 848 called for the establishment of an Interagency Council of the Prevention of Sex Offenses.  The purpose of this council is to evaluate services and programs sponsored either by the state, federal, or private organizations concerning the prevention of sex offenses and treatment of sex offenders.  The Council is also responsible to evaluate effective law enforcement and monitor the quality and effectiveness of other activities and services involved in the administration of sexual offense laws of the state, to reduce the conflict and the duplication of efforts between state and local resources, and to ensure proper and efficient operations in the prevention of sex offenses and the treatment of sexual offenders.  In accordance with that purpose, the council is required to evaluate in state and out of state programs for sexual offender treatment, collect and disseminate information regarding sexual offender treatment programs (private and public) to judicial officers, probation and parole officers, and the general public, and establish and maintain a Registry of individuals and programs providing mental health and medical services for sexual offenders in accordance with Section 936 of Act 848.

Section 936 of Act 848 requires that the Council establish and maintain a Registry of individuals who provide mental health or medical services for the rehabilitation of sex offenders.  The Council, by rule, shall develop procedures and eligibility requirements for registration.  The Council may set a reasonable fee for registration (currently set to $0) to cover the cost of administering the Registry.  The Council shall also prepare a list of treatment providers registered under this sectionThe Council, by rule, shall establish procedures for developing and distributing the list.  The Council on request shall make the list available for a reasonable fee to cover the cost of printing and distribution.

In 1999, Act 848 was enacted by the Legislature of Louisiana giving authority to manage the Registry to the Office of Mental Health.  The Office of Mental Health has in turn contracted with a private agency to compile the data for the Registry and distribute the information for the Registry.  The Office of Mental Health and the private contracted agency are not responsible for making decisions regarding the Registry applications or the Registry requirements -- those tasks are within the purview of the Interagency Council.
